Maintenance 125CrPC
Maintenance 125CrPC to Wife:
- According to Section 125 (1) (a) of the Criminal Procedure Code of 1973, a magistrate of the first class may, upon proof of the husband's inability to support himself, order the husband to pay a monthly allowance at a rate the magistrate deems appropriate.
- This applies to any man who has sufficient means and neglects or refuses to support his wife.
Maintenance 125CrPC to Children:
- Maintenance is provided to a child who is unable to support themselves under Section 125(1)(b). This child may or may not be married, and they may be illegitimate.
- Section 125 (1)(c) offers maintenance to a legitimate or illegitimate child (who is not a married daughter) who has reached adulthood but is unable to support themselves because of an injury or physical or mental abnormality.
Maintenance 125CrPC to Parents:
- Maintenance is provided to parents who are unable to support themselves under Section 125(1)(d).
- A magistrate may, upon proof of refusal or negligence on the side of an individual with sufficient resources, order the payment of a monthly allowance at a predetermined rate determined by the magistrate. The allowance would be paid to the magistrate on a periodic basis.
